These Terms govern the relationship between you (“You”, or “User”) and FullStory regarding the use of the Bwamp Services. By accessing, installing, downloading, or otherwise using the Bwamp Services, You agree to be bound by these Terms. If you do not agree to the Terms, You may not use the Bwamp Services.
You acknowledge that, as between You and FullStory, the Bwamp Services are owned by and are the property of FullStory. Except for the limited, non-assignable, non-transferable license expressly granted to you herein, You do not gain any ownership, right, title, or interest in or to the Bwamp Services or any other intellectual property rights of FullStory.
We grant you the right to use the Bwamp Services, subject to the following restrictions:
You are responsible for any use of the Bwamp Services that occurs under your login credentials. If you believe Your account has been compromised, you must notify us as soon as possible.
All information you provide when you register for an account or use the Bwamp Services is governed by our Privacy Policy, which is incorporated herein, and we may take any action with respect to your information that is consistent with our Privacy Policy.
We monitor and collect usage data relating to the use of the Bwamp Services to: (i) prevent or address service or technical issues, and/or (ii) improve the Bwamp Services and Your experience.
The Bwamp Services are provided: (a) free of charge; (b) without support; (c) “AS-IS”; and (d) without indemnification, warranty, or condition of any kind. No service level commitment of any kind will apply to the Bwamp Services. To the extent you use the Bwamp Services, you do so at your own risk, and, to the maximum extent allowable under applicable law, We disclaim any liability for Your use.
We may modify or terminate the Bwamp Services at any time, and any such modification or termination will solely be at our discretion.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS OF A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AS WELL AS ANY WARRANTIES ARISING FROM COURSE OF DEALING OR COURSE OF PERFORMANCE RELATING TO THE BWAMP SERVICES. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE OR FREE FROM DEFECTS OR ERRORS.
Our aggregate liability (excluding indirect damages, for which We expressly disclaim all liability), as well as that of Our affiliates and suppliers, for any claim arising from your use of the Bwamp Services will not exceed $1 USD.
You may provide suggestions and/or comments regarding the Bwamp Services, but you have no obligation to do so. If you do provide such suggestions and/or comments, We may use that feedback without any restriction, and you hereby irrevocably assign to us all right, title, and interest in and to that feedback.
This Agreement is governed by the laws of the State of Georgia.
